For many across the globe, the United States of America has long been the shining ideal of a free and democratic society. However, recent voter-suppressing legislation enacted in Kansas threatens to snuff out this light for good. As SB 244 becomes law, America is closer than ever to becoming a competitive oligarchy.
What is a Democracy?
Though countless attempts have been made to identify what elements make a democracy, most experts broadly agree that unencumbered access to elections is a crucial component. This means that all adult citizens of every race, gender, and economic status have the legal right to vote and are not required to overcome a poll tax of any form to participate in the electoral process.
Conversely, utilizing Dahl’s seminal work, regimes that do not allow for complete civic participation can be identified as closed hegemonies, which lack contestation as well, or competitive oligarchies, which allow for the state leader to be challenged.
America’s Ongoing Struggle
While America has previously faced numerous struggles to achieve full enfranchisement for adult citizens, with all races and genders only being able to easily access the polls following the adoption of the Voting Rights Act of 1965, a general belief in the country’s defense of human rights and democratic norms has been pervasive in the decades since.
The serious cracks in this reputation appeared throughout Donald Trump’s first Presidency, as he used his platform to prey on Americans’ anxieties, sow constant hate and division, and challenge the will of the people on Election Day. The social divisions and political distrust that marked the first Trump Administration only grew as he reluctantly left office with the message that his opponents were intentionally sabotaging him, and by extension, his supporters. Consequently, a wave of harmful legislation targeting the marginalized groups he villainized, such as the LGBTQ+ community, swept across the nation and eventually helped lift Trump back to the Presidency.
Among the approximately 3,400 anti-trans bills that have been considered in the U.S. throughout this time since 2021, no bill targeting citizens’ right to vote has been successful — until now, in Trump’s remade America.
Kansas’s SB 244 – What is it?
Passed into law by the Republican supermajority on February 18th, 2026, following a motion to override Governor Laura Kelly’s veto, Kansas’s SB 244 is America’s largest step away from democracy towards competitive oligarchy yet.
This bill, among other discriminatory acts, immediately invalidated any state-issued legal identification materials containing a gender marker that has been updated to match a transgender citizen’s identity, with no grace period. More than 1,800 citizens may be affected, and at least 300 of those impacted have already received letters informing them that their current identification materials, including their birth certificates and driver’s licenses, are no longer valid.
For residents to ensure that they possess legally valid IDs in a state that has some of the harshest voter identification laws in the country, they must immediately surrender their IDs to the state and will subsequently be barred from updating their gender marker again.
Due to the purposefully rushed nature of the legislation, it is currently unclear if those affected will have to pay a fee to secure a new, valid ID, how much that fee may be, and how long it will take to receive the updated materials.
An Attack on Core Democratic Principles
This blatantly unconstitutional law is highly detrimental to America’s status as a democracy.
To cast a ballot in Kansas, voters must provide a “valid form of identification” at the polls on Election Day, or provide their valid driver’s license number or a copy of their valid photo ID when voting via absentee ballot. If an impacted voter does not have a federal identifier, such as a passport, as over 60% of the Kansas population does not, they will be required to fill out a provisional ballot and provide further proof of their identity after they leave the polls. This provisional ballot is at risk of being rejected “if the voter fails to provide the necessary information requested by the election officer or if the information is inconsistent with what is on the voter registration list.”
Under these strict guidelines, transgender citizens of Kansas are in an extremely precarious situation. If today were Election Day and they did not currently possess a passport, they would not be able to vote. Come the Primaries and Midterms in August and November, they still may not be allowed to vote. Even if a citizen possesses a passport or updates their ID, they face the risk of being turned away or having their ballot rejected under suspicion of election fraud if their outward gender presentation does not match the gender marker on their new ID.
Additionally, if it is determined that citizens do have to pay a fee to change their gender marker, this would become a targeted poll tax.
This direct attack on the citizens’ right to vote is a calculated attempt to prevent Americans from holding their unsatisfactory leaders accountable by voting them out of office. Assaults on vertical accountability — the citizens’ ability to ensure their government is liable for their actions — such as this, are hallmark symptoms of democratic erosion. Since individual states in America are commonly thought of as “laboratories of authoritarianism,” per Bartels et al., it is likely that this symptom will spread and lead the U.S. into becoming a competitive oligarchy if the backsliding is not halted and reversed.
Haven’t We Been Here Before?
Although the U.S. was not always a country with total enfranchisement, significant, hard-fought progress has been made to expand the right to vote to all adult citizens. To dismantle these achievements in any way is entirely incompatible with the most basic definitions of democracy and is a textbook example of backsliding.
Alarmingly, these attacks on election integrity and the right to vote are receiving widespread support from both state and federal officials and the President in a manner that is entirely unprecedented in U.S. history.
In addition, due to the 2024 Supreme Court ruling in Trump v. United States, this is the first time in American history in which a President has enjoyed full legal immunity for any of his “official acts.”
This dangerous combination has brought the government to ideas that were previously unthinkable in the recent past.
The passing of SB 244 comes amid the Congressional debate on the SAVE America Act, a piece of federal legislation that will implement nationwide voter ID requirements and similarly impact the validity of voter identification materials for transgender individuals and women across the country. This timing is particularly concerning as the success of SB 244 demonstrates that revoking legal identification with no prior warning or grace period is both possible and acceptable. As the election season rapidly approaches, and many other government officials, including the President, openly share this oppressive goal, what is stopping them from doing the same?
Conclusion
If America wants to avoid a total transformation into a competitive oligarchy, citizens and lawmakers alike must reject all attacks on voting rights and come together to rebuild the strength of respected institutions and the faith of the world.
